These Terms of Service ("Terms") govern your use of the Cartoo mobile application and related services ("Service") operated by Cartoo ("we", "us", "our"). By using our Service, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using the Cartoo app, you confirm that you are at least 18 years old (or have parental consent), have read and agree to these Terms, and agree to our Privacy Policy.
2. Description of Service
Cartoo is a hyperlocal marketplace platform that connects customers with local shops and delivery partners in villages and rural areas. We facilitate transactions between buyers and sellers but are not a party to the transaction itself.
3. User Accounts
- You must provide a valid phone number to create an account
- You are responsible for maintaining the confidentiality of your account
- You must notify us immediately of any unauthorised use of your account
- One account per person; multiple accounts are not permitted
- We reserve the right to suspend or terminate accounts that violate these Terms
4. Orders and Transactions
- Orders are subject to availability and confirmation by the shop
- Prices displayed are set by individual shop owners and may change
- Cartoo charges a platform fee on each transaction
- We are not responsible for the quality, safety, or legality of products listed by shops
- Delivery times are estimates and may vary due to traffic, weather, or other factors
5. Payments
- Payments are processed securely through our payment partners
- Cash on delivery is available in supported areas
- All prices are inclusive of applicable taxes unless stated otherwise
- Payment disputes should be raised within 48 hours of delivery
6. Prohibited Activities
You agree not to:
- Use the Service for any illegal or unauthorised purpose
- Submit false, misleading, or fraudulent orders
- Harass, abuse, or harm shop owners or delivery partners
- Attempt to reverse engineer or hack the application
- Use automated tools, bots, or scrapers on the platform
- Post fake reviews or ratings
7. Intellectual Property
All content in the Cartoo app — including logos, design, text, and software — is the property of Cartoo and protected by applicable intellectual property laws. You may not copy, modify, or distribute our content without prior written permission.
8. Limitation of Liability
To the maximum extent permitted by law, Cartoo shall not be liable for:
- Product quality issues from third-party shops
- Delivery delays beyond our reasonable control
- Indirect, incidental, or consequential damages
- Loss of data or business interruption
9. Dispute Resolution
Any disputes arising from these Terms shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the jurisdiction of courts in Maharashtra, India.
10. Modifications
We may update these Terms at any time. Significant changes will be notified via the app. Continued use of the Service after changes constitutes acceptance of the new Terms.
11. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion with or without prior notice.
